These Terms & Conditions explain how Scene Creative works, what you can expect when using this website or working with me, and the basic terms that apply to projects, services and ongoing support.

Scene Creative is the public-facing brand of Jason Rae, a registered business based in Jersey, Channel Islands.

By using this website, requesting a quote, accepting a proposal or working with Scene Creative, you agree to these Terms & Conditions unless different terms have been agreed in writing.

1. About Scene Creative

Scene Creative provides creative and digital services including website design, website refreshes, digital marketing, Google Ads, Meta Ads, photography, video production, graphic design, branding, print design, social content, hosting support and related services.

Most work is provided directly by Jason Rae. Where a project requires additional skills or capacity, I may work with trusted freelancers, contractors or industry professionals.

2. Quotes and proposals

Quotes and proposals are based on the information provided at the time.

A quote may include details such as:

• Project scope
• Deliverables
• Estimated timeline
• Fees and payment terms
• Third-party costs
• Ongoing support or hosting options
• Any assumptions or exclusions

Quotes are valid for 30 days unless stated otherwise.

If the project requirements change, the quote may need to be updated.

3. Accepting a quote

A project is usually considered accepted when you confirm approval by email, pay a deposit, or otherwise ask me to begin work.

Once a project is accepted, these Terms & Conditions apply alongside the agreed quote, proposal or written project scope.

If there is a conflict between these Terms & Conditions and a specific written proposal, the proposal will usually take priority for that project.

4. Deposits and payments

Projects may require a deposit before work begins.

Unless agreed otherwise:

• Deposits are due before work starts
• Final balances are due before launch, file release or final handover
• Ongoing hosting, support or marketing retainers are billed monthly, annually or as otherwise agreed
• Third-party costs may need to be paid upfront

Payment terms will be shown on the invoice or agreed in writing.

If payment is late, I may pause work, delay launch, suspend support or withhold final files until payment is received.

5. Scope of work

Each project is based on an agreed scope.

The scope may include specific pages, features, designs, deliverables, revisions, campaigns, content, shoot days, edits or support hours.

Work outside the agreed scope may be quoted separately or charged as additional work.

Examples of additional work may include:

• Extra website pages
• Additional design concepts
• Major copy changes
• Extra rounds of revisions
• New functionality
• Additional photography or video edits
• Campaign changes beyond the agreed setup
• Urgent work or short-notice deadlines
• Fixing issues caused by third-party changes, hosting problems, plugins or client edits

6. Revisions and approvals

Reasonable revisions are usually included as part of a project, within the agreed scope.

Revisions should be used to refine the agreed direction, not to restart the project from scratch or add substantial new work.

You are responsible for reviewing work carefully and providing clear feedback in a timely manner.

Once work is approved, later changes may be treated as additional work.

7. Timelines

I will always aim to work to agreed timelines, but project timings depend on several factors, including:

• Prompt client feedback
• Timely supply of content, images, logins and approvals
• Third-party services
• Hosting, domain or technical access
• Changes to project scope
• Availability for meetings, shoots or reviews

If delays are caused by missing content, delayed feedback or changes to the brief, the timeline may need to move.

8. Client responsibilities

To complete a project properly, you may need to provide:

• Written content or source information
• Images, videos, logos or brand assets
• Access to your website, hosting, domain, email, Google, Meta, HubSpot or other accounts
• Feedback and approvals
• Accurate business, pricing, service and legal information
• Permissions for any third-party content you provide
• Confirmation that content is accurate before publication

You are responsible for checking that all final content is accurate, lawful and suitable for your business before it is published or printed.

9. Content, images and supplied materials

You must have the right to use any content, images, videos, fonts, logos, documents, data or other materials you provide.

If you supply materials for use in a project, you confirm that their use will not infringe the rights of any third party.

I am not responsible for copyright, licensing, privacy or permission issues arising from materials supplied by you.

10. Photography and video

For photography or video projects, the intended use of the content should be agreed before the work begins.

This may include use on websites, social media, advertising, print materials, internal training, campaign pages or other agreed channels.

Where people are featured in photography or video, it is your responsibility to ensure that appropriate permissions, consent or internal approvals are in place, unless agreed otherwise.

Additional edits, formats, cutdowns, reshoots or revisions outside the agreed scope may be charged separately.

11. Website design and development

Website projects may include design, build, content support, forms, basic SEO, tracking setup, hosting support or other agreed features.

Unless agreed otherwise, websites are built using commonly available platforms, plugins, tools and third-party services.

I aim to build websites that are professional, practical, mobile-friendly and easy to manage, but I cannot guarantee that a website will be completely error-free or compatible with every browser, device, plugin, update or third-party system indefinitely.

After launch, ongoing support, updates, hosting or maintenance may be provided under a separate agreement or monthly package.

12. Hosting, maintenance and support

Where hosting, maintenance or website support is provided, the details will be agreed separately.

Support may include items such as:

• Website updates
• Plugin and theme updates
• Backups
• Security checks
• Minor content updates
• Basic troubleshooting
• Hosting management

Support does not usually include major redesigns, new functionality, large content changes, SEO campaigns, copywriting, photography, video, advertising work or fixing problems caused by third-party changes unless agreed separately.

If hosting or maintenance payments are missed, support or hosting services may be paused or cancelled.

13. Domains, hosting and third-party services

You may need third-party services such as:

• Domain registration
• Website hosting
• Premium plugins or themes
• Stock images or fonts
• Email services
• Booking systems
• CRM tools
• Analytics tools
• Advertising platforms
• Payment providers

These services are usually subject to their own terms, fees and privacy policies.

Unless agreed otherwise, you are responsible for third-party costs and ongoing subscriptions.

I am not responsible for outages, price changes, policy changes, technical issues or service failures caused by third-party providers.

14. Google Ads, Meta Ads and digital marketing

Digital marketing services may include campaign setup, ad copy, targeting, creative, landing pages, tracking, reporting and ongoing management.

You are responsible for ad spend unless agreed otherwise.

I will aim to set up and manage campaigns carefully, but I cannot guarantee specific results, sales, enquiries, rankings, leads or return on investment.

Campaign performance can be affected by many factors, including budget, competition, website quality, landing pages, offer strength, seasonality, market demand, tracking limitations and platform changes.

15. Search engines, SEO and rankings

I may provide basic SEO setup or content structure as part of website work.

This may include page titles, descriptions, headings, image alt text, redirects, sitemap setup, Search Console support or basic technical improvements.

I cannot guarantee specific search rankings, traffic levels or search engine performance.

Search engines can change how they rank websites at any time.

16. Intellectual property and ownership

Unless agreed otherwise, once full payment has been received, you will own the final approved deliverables created specifically for your project.

This may include final website designs, graphics, written content, edited videos, photographs, print artwork or campaign assets.

Scene Creative may retain ownership of:

• Working files
• Draft concepts
• Unused designs
• Source project files
• Templates
• Processes
• Code snippets
• Pre-existing tools, methods or materials
• Licensed third-party assets

Editable source files may be supplied if agreed in advance or quoted separately.

Third-party assets, fonts, plugins, stock media and software remain subject to their own licences.

17. Portfolio and showcase use

Unless agreed otherwise, I may show completed work in my portfolio, website, proposals, social media, case studies or marketing materials.

This may include business names, project descriptions, website screenshots, brand visuals, photography, videos or examples of delivered work.

If a project is confidential or you would prefer certain work not to be shown publicly, please let me know in writing.

18. Confidentiality

I will treat confidential business information with care and will not intentionally disclose it to others unless needed to deliver the project, required by law, or agreed with you.

If additional freelancers or suppliers are involved, I will only share the information they need to complete their part of the work.

19. Data protection

Personal information is handled in line with the Scene Creative Privacy Policy.

If a project involves personal data, client data, employee images, customer information or mailing lists, both parties agree to handle that information responsibly and lawfully.

If more detailed data processing terms are needed for a project, these can be agreed separately.

20. Cancellations and paused projects

If you cancel a project after work has started, you may be charged for work completed, time spent, costs incurred and any committed third-party expenses.

Deposits may be non-refundable once work has begun.

If a project is paused for a long period due to delayed feedback, missing content or lack of communication, I may need to reschedule the work or requote before continuing.

21. Ongoing retainers and monthly services

Ongoing services may include website support, hosting, content updates, marketing support, Google Ads management, Meta Ads management or other monthly work.

The scope, fee and cancellation terms for ongoing services will be agreed separately.

Unless agreed otherwise, monthly services can usually be cancelled with 30 days’ notice.

Any outstanding invoices or third-party costs remain payable.

22. Limitation of liability

I will always aim to provide services with reasonable care and skill.

However, to the fullest extent permitted by law, Scene Creative will not be liable for:

• Loss of profits
• Loss of business
• Loss of revenue
• Loss of data
• Loss of goodwill
• Indirect or consequential loss
• Issues caused by third-party platforms, plugins, hosting, advertising platforms or software
• Problems caused by client changes, missing updates, unauthorised access or misuse

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

If you are a consumer, nothing in these Terms & Conditions affects your statutory rights.

23. Website information

The information on this website is provided for general information only.

I aim to keep information accurate and up to date, but I do not guarantee that all content will always be complete, current or error-free.

Examples of work, case studies or project descriptions are provided to show the type of work delivered. Results may vary depending on the business, budget, market, timing, offer and ongoing activity.

24. External links

This website may include links to third-party websites or services.

I am not responsible for the content, availability, privacy practices or terms of any third-party websites.

25. Changes to these Terms & Conditions

These Terms & Conditions may be updated from time to time.

The latest version will always be available on this website.

For existing projects, the terms agreed at the time of acceptance will usually apply unless changes are agreed in writing.

26. Governing law

These Terms & Conditions are governed by the laws of Jersey.

Any disputes will be subject to the jurisdiction of the courts of Jersey, unless otherwise required by law.
